Saudi Arabia Approves Amendments to Patent Law

RIYADH – The Kingdom of Saudi Arabia Council of Ministers approved the amended Patent and Industrial Design Law, which entered into force on October 03, 2023.

The amendments implement significant amendments to the previous version of the Patent and Industrial Design Law, notably including:

- Hague Agreement: Saudi Arabia became a member of The Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents (Apostille).

- Design Protection: The protection term of design has been extended to 15 years instead of 10 years.

- Fees: If three years expire before the Patent Office makes a decision on the merits of the application, the applicant may abstain from payment of fees until the Office makes a decision to grant the patent, and shall, in such case, pay all unpaid annual fees.
