KARACHI - The Federal Government of Pakistan has announced the adoption of new Industrial Designs Rules 2023, under the power conferred by section 31 of the Registered Design Ordinance 2000.
The new Rules repeal the Design Rules 1933 and seek to streamline the filing and prosecuting of industrial designs in Pakistan. Salient features of the New Rules are summarized as follows:
Adoption of the current International classification system: The Amendment Rules mark Pakistan’s adoption of the prevailing edition of the International Classification published by WIPO. New Fees: New set of fees for filing design applications has been introduced. The fees for filing a single design are Rs 3000, while the fees for filing a set of designs are Rs 5000. Timeline has been introduced to issue an office action: Filing date will be the date on which the Patent Office receives the document. The time to reply to an examination report is two months from the date of issuance of the office action, extendable to 6 months.
Restoration of the lapsed design: Restoration of the lapsed design due to failure to comply with the prescribed rules became allowed.
