Pushing the Limit: Updates on Brazil's PPH Program and Alternative Routes to Speed ​​Up the Exam

The Brazilian Patent and Trademark Office (BPTO) has announced that the annual limit of 800 applications to participate in the Patent Prosecution Highway (PPH) program has been reached as of July 6, 2023.

It should be noted that this limit was reached much earlier than in the previous annual cycle of 2022, which did not close until November. This early achievement of the cap indicates the effectiveness of the PPH program and the growing confidence of many applicants who have consistently applied for acceleration, resulting in the cap being reached even before the end of the year.

Consequently, no further PPH applications may be submitted until a new Ordinance is published. We anticipate that the PPH program will probably not restart until early 2024.
