Proposed Amendments to Indonesia’s Patent Law

Indonesia is proposing the following patent changes: 

  1. Applicants claiming priority rights that missed the 12-month deadline will have the opportunity to claim priority within four months of the deadline (with an additional fee).  
  2. Applications deemed withdrawn because the necessary formality documents where not filed, may be filed again for an additional fee.  
  3. Substantive examination will take place after a request for it is filed. This is different from the current practice, which takes place after the end of publication period.  
  4. Applicants will be able to request a reexamination. This reexamination request must be filed within six months of the grant decision.
