The Russian parliament approved a government draft law that allows the production of drugs without the consent of the owner of the patent rights.
The law was prepared by the Federal Antimonopoly Service as part of the implementation of the National Plan of Development of Competition.
According to the law, the Russian government will be able to make a decision on the use of an invention, utility model, or industrial design without the consent of the patent holder only in case of emergency related to ensuring defense and security, including protecting the life and health of citizens.
The right holders will be notified of the use of their intellectual property and will receive commensurate compensation. The methodology for determining the amount of compensation and the procedure for its payment will be determined by the government.
According to the Antimonopoly Service, the changes will make it possible to quickly solve the problem of the absence or shortage of foreign patented drugs and medical devices in the country.
